Big Boy Scooters Code of Conduct

In order to ensure a happy experience of purchasing a Big Boy Scooter, the following terms and conditions of sale have been posted to advise customers and dealers of their rights. Purchasing a Big Boy Scooter means you have read and accepted the Big Boy Scooters Code of Conduct:
 
Pricing: All prices advertised are suggested retail prices including VAT. Big Boy Scooters and the authorized dealer reserve the right to change prices without notice. Prices strictly include Pre Delivery inspection as per the warranty book and Big Boy Roadside Assist (Licensed models only). Prices strictly exclude: Registration, license and number plate fees, 1st service and services thereafter, Delivery costs from the dealer to the customer, Extra delivery cost for dealers selling outside South African Borders.
 
Payment: Strictly as per agreed terms – EFT or Cash. Credit Card payment accepted by arrangement. Dealer may make finance application on behalf of the client however no item may be released without notification from the financial service provider to Big Boy Scooters Head Office. No Cheques accepted unless bank guaranteed or fully cleared. Motorcycle Registration Papers or NATIS Release forms may not be released to customer until payment has been made in full. Legal ownership of the goods will be passed to the purchaser once the dealer has paid Big Boy Scooters Head Office in full.
 
Upon taking Delivery of Motorcycle: Please ensure at point of delivery, motorcycle is 100% operational and free of any damages. Any non-operational items / damages, cosmetic or otherwise, must be documented on both the Dealers Delivery Note / Tax Invoice and Warranty book.
You are required to receive the following items upon accepting delivery:
·  Warranty Book
·  Owners Manual
·  Tax Invoice from the selling Dealer.
·  NATIS Manufacturers Certificate (Except for Youth Quads)

Warranty Book: It is the responsibility of the dealer / seller to ensure a warranty book has been issued, correctly filled out and signed by the purchaser. The dealer / seller shall FAX the top copy of the warranty book details with the TAX INVOICE to 086 519 0229, this copy is then to be kept by the dealer for a period of 1 year and may be requested by Big Boy Scooters at any time.
 
Warranty Activation: After the warranty registration has been submitted by the dealer / seller to Big Boy Scooters Head office, it is the purchasers responsibility to activate the warranty by either calling 0861 BIG BOY or via the www.bigboyscooters.co.za website, following the warranty activation link. The purchaser’s details are confirmed and 9 questions are asked for record purposes. All information gathered is secure and is not disclosed to any 3rd party.
 
Pre Delivery Inspection: It is the selling dealers responsibility to assemble and carry out a Pre Delivery Inspection (21 Point Check). The record of this inspection is stamped and signed by the responsible dealer representative in the warranty book on page 4.
 
Service Intervals: (May only be carried out by an authorized Big Boy Dealer)
Pit Bikes, Motorcycles and Monster ATV’s without instrumentation:
·  5 Full Tanks / 1 Month from date of purchase (whichever comes 1st) – RUN IN SERVICE
·  20 Full Tanks / Every 3 Months (whichever comes 1st) – SERVICE AS PER OWNERS MANUAL
 
Scooters and Motorcycles used for road use:
·  300km – RUN IN SERVICE
·  Every 2000kms thereafter – SERVICE AS PER OWNERS MANUAL
 
ATV’s with instrumentation:
·  10 Hours / 1 Month from date of Purchase (whichever comes 1st) – RUN IN SERVICE
·  50 Hours / 3 Months (whichever comes 1st) – SERVICE AS PER OWNERS MANUAL
 
Owners Manual: It is the responsibility of the dealer / seller to ensure the buyer receives the owner’s manual. Big Boy Scooters will not accept responsibility to any failure as a result to instructions by the owner’s manual not being adhered to.
 
Tax Invoice from Dealer: It is the responsibility of the Dealer / seller to provide the purchaser with a tax invoice / receipt as proof of purchase. Minimum of Customer name and contact number is required.
 
Natis Release Form / Registration Certificate: The NATIS Manufacturers Certificate will only be released once Big Boy Scooters Head Office has received proof of payment from the dealer / seller. NATIS Registration Certificates determine ownership in terms of the National Road Traffic Act and are issued for all Big Boy Scooter models except quadrocycles for youths (Monster JNR 100 / CR 110 / CR 125). It is the customer’s right to obtain a NATIS Manufacturers Certificate after purchasing a Big Boy Scooters Product. All costs for Registration and Licensing are for the purchasers account.
 
Big Boy Scooters Factory Warranty: Standard warranty is a Limited 1 year manufacturer’s warranty, which protects the consumer from incorrectly manufactured or assembled components only.
The warranty period may differ from item to item and may be waivered if described on the delivery note / tax invoice. The product will be repaired as per the warranty terms and condition.
 
Big Boy Road Side Assist: Big Boy Roadside Assist is subject to the Big Boy Road Side Assist Terms and Conditions and is valid for a period of 1 year from date of warranty activation.
 
Returns: No cash refunds. No Exchanges. Should the Big Boy Scooter product not be able to be repaired, Big Boy Scooters reserves the right at its own discretion to replace the motorcycle. All costs for de-registration and re registration / licensing are for the purchasers account.
 
Parts: Parts prices quoted are suggested retail including VAT. Prices exclude transport cost from Big Boy Scooters head office to the dealer. Part availability is ex-stock. If parts are not in stock, 3-4 weeks waiting period may apply.

Workshop Repairs:
Strictly C.O.D. Workmanship and parts warranty of workshop repairs is limited to 2 weeks from date of collection. All workshop work must be quoted either upon “booking in” of the job card or after evaluation of the scope of work. Any quote strictly does NOT account for unforeseen damages / work. Should unforeseen work be required, this work must be quoted and approved before commencement. Any workshop work not collected with 7 days will be subject to a storage daily storage charge of R 50.00 p/day. All workshop work not collected within 1 month will be sold to recoup cost of workshop repair and storage incurred only.
 
Workshop Labour Rate: Workshop labour rates may differ from dealer to dealer. Big Boy Scooter recommended labour rate is R 300.00 incl VAT for the 1st hour and R 150.00 incl VAT per hour there after.
 
General Service Fee: Service Fee may vary from product to product and dealer to dealer. Big Boy Scooters recommended service fee is 1 hours labour (R 300.00 incl VAT) plus a sundry charge of R 95.00 incl VAT. Any additional parts and labour are quoted over and above the service charge. All additional work should be quoted by the dealer and approved by the customer before work commences.

Big Boy Limited Warranty

Big Boy Scooters cc (Big Boy) covers each product against defects in material or manufacturing as follows:

1. Labour

1.1 For a period stipulated for each product from the date of purchase, if this Product is determined to be defective, Big Boy will repair the Product at no charge or
pay the labour charges to any Big Boy Authorized Service facility. After the Warranty Period, the customer must pay for all labour charges.

1.2 Big Boy Scooters will not pay any labour charges unless the warranty claim has been approved.

2. Parts

2.1 In addition, Big Boy will supply, at no charge, repaired or equivalent replacement parts in exchange for defective parts for the stipulated period. After the stipulated period, labour for removal and installation is available from Big Boy Authorized Service Facilities are at the customers expense.

2.2 All defective parts remain property of Big Boy Scooters cc.

2.3 Big Boy Scooters cc reserves the right to modify, make design changes to any models at anytime without incurring any obligation to make such design changes and modifications to any motorcycles previously manufactured and /or sold.

2.4 Big Boy Scooters reserves the right to repair damaged or warranty parts if deemed necessary.

3. Freight costs

3.1 To obtain warranty service, the customer must take the product, or deliver the product freight prepaid, in either its original packaging or packaging affording equal degree of protection, to any Authorized Big Boy Service Facility.

3.2 Big Boy Scooters will not be responsible for any freight costs, recovery, collection or delivery by any third party.

3.3 Big Boy Scooters will be responsible for freight costs of warranty parts to the authorised dealer only after warranty approval.

4. General Limits of the warranty

4.1 It is at the sole discretion of Big Boy Scooters head office to authorise any warranty claims.

4.2 This warranty does not cover customer instruction, set-up adjustments or Product modification outside the original factory configuration.

4.3 This warranty is designed to protect the customer against manufacturing and assembling defects only, no claim may be made to normal wear and tear or any failure resulting from wear and tear.

4.4 It is the customer and dealer's obligation to make sure the product is 100% operational and complete upon delivery, any claims to the following items thereafter will not be claimable, even if the product is in the warranty period: Light lenses, light globes, side view mirrors, clutch lever and perch, brake lever and master cylinder, grips, bar end protectors, handlebars, clutch assembly, battery, air filter, fuses, tubes, tyres, chain, sprockets, belts, missing or loose spokes, missing bolts and nuts.

4.5 No warranty claims may be made for missing parts on crated units, all products are fully assembled, passed inspection in factory and then packaged. If crates look tampered or damaged, do not accept delivery and call Big Boy Scooters.

4.6 It is the customer's responsibility to ensure the owners manual for the product has been received. Big Boy will not warrant any failure due to non adherence of the owners manual from the manufacturer. This includes running in procedure and failure due to improper maintenance.

4.7 It is strongly recommended to only use Big Boy Approved makes of engine oil, two stroke oil, brake fluid and Air filter oil! Big Boy Scooters recommends CASTROL Motorcycle specific Lubricants.

4.8 This warranty does not cover any damage due to improper fuel, engine oil, two stroke oil mixture, failure to adequately oil the air filter nor may any claim be made for replacement servicing materials such as but not limited to Oils, Grease, Fuel, and cleaning materials.

4.9 The warranty does not cover cosmetic damage or damage due to acts of God, UV Light, Competition use, accidents, misuse, abuse, negligence, commercial use, or modification of, or to any part of the Products, including the motor and batteries.

4.10 This warranty does not cover products sold AS IS or WITH ALL FAULTS.

4.11 This warranty is valid only in South Africa.

4.12 The warranty is void if the vehicle has undergone change of ownership during the warranty period. The warranty is not transferable from the original purchaser.

4.13 The warranty is void if the product has been purchased via a none authorised dealer and if attempted repair by anyone other than a facility authorized by Big Boy
to service this product.

4.14 The warranty will be void unless Warranty registration by both dealer and customer using the S&W reference number with Proof of purchase in the form of a bill of sale or receipted invoice, which is evidence that the unit is within the Warranty Period, and that each service has been carried out.

4.15 This warranty is invalid if the factory-applied Vehicle Identification Number (VIN) has been altered or removed from this product.

Repair or replacement as provided under this warranty is the exclusive remedy of the consumer. Big Boy shall not be liable for any incidental or consequential damages for breach of any expressed or implied warranty on this product. Except to the extent prohibited by all applicable law, any implied warranty or merchantability or fitness for particular purpose on this product is limited to the duration of this warranty.

Big Boy Road Side Assist

Big Boy Road Side Assist – 083 900 7266

Terms and Conditions of Big Boy’s Nationwide 24hour Roadside Assist.
  1. Free to the customer with any purchase of road legal Big Boy as from 1st January 2009
  2. Big Boy Roadside Assist is subject to activated warranty and service scheduled being adhered too.
  3. Big Boy Roadside Assist is Vin number related and is transferable from the 1st owner as long as the service schedule is up to date at time of sale.
  4. Big Boy Roadside Assist is not available for commercial customers unless previously arranged.

The following points are considered misuse, of which Big Boy reserve the right to impound the vehicle until relating charges are paid:

  • Vehicle has not been serviced as per recommended service intervals.
  • Vehicle has been delivered to dealer and is in working order.

The services rendered by the AA are strictly the following:

  • 24 Hour National Roadside assist.
  • Medical assistance
  • Change / repair of flat tyre.
  • Jump-start
  • Mobile battery replacement at an extra cost.
  • Out of fuel – provision of fuel to a maximum of 5 litres.
  • Locksmith services.
  • Tow-in to an authorised Big Boy Dealer should there be a mechanical or electrical breakdown on the public road.
